Bio

Eric B. Smith joined Timoney Knox, LLP in August 2018 as a partner and Chair of the Firm’s Litigation Group.  He is admitted to practice in Pennsylvania, the U.S. District Courts for the Eastern District, Middle District and Western District of Pennsylvania and the United States Third Circuit Court of Appeals.  Mr. Smith’s practice focuses on complex real estate, commercial and municipal litigation, business disputes, as well as related transactional matters.  His law practice spans across the Commonwealth of Pennsylvania.

Mr. Smith’s commercial litigation practice includes the representation of clients in contract and business disputes, and with respect to confessions of judgment, commercial lease disputes, mechanics’ liens, Contractor and Subcontractor Payment Act claims, construction claims and unfair trade practice claims.  Mr. Smith formerly served as Regional Outside Counsel for a large national big-box home improvement retailer in the region that includes Pennsylvania, New Jersey, Maryland, Delaware and the District of Columbia.

Mr. Smith’s real estate litigation practice includes the defense and prosecution of title claims, adverse possession, easement and boundary disputes, quiet title, reformation, partition, planned community litigation, zoning, and over-turning upset tax sales.  Mr. Smith has served as a court-appointed master-in-partition for the Orphans’ Court Division of the Court of Common Pleas of Montgomery County and as a court-appointed real estate trustee charged with liquidating disputed real estate.  Also, in connection with his real estate law practice, he negotiates and drafts agreements of sale, letters of intent, notes, leases, and various recordable instruments, such as mortgages, deeds and easements.

He also is on the forefront of advocacy and litigation on behalf of Short-term Rental owners and operators.  In connection with Short-term Rentals, Mr. Smith provides advice, representation and advocacy for a wide array of issues presented by Community Association governance and restrictions as well as Township Ordinances.  Mr. Smith also works closely with advocacy groups serving the Short-term Rental and tourism industries in Pennsylvania.

Mr. Smith’s represents business executives, owners, partners and shareholders in litigation pertaining to Pennsylvania’s Business Corporation Law, Partnership Act, Limited Liability Company Law, Non-Profit Corporation Law, Wage Payment and Collection Law and non-compete agreements.  Mr. Smith also represents attorneys in the course of litigious law practice separation.

Mr. Smith’s municipal practice includes home rule charter law as well as municipal litigation. For nearly 20 years, he served as the Solicitor for the City of Reading Charter Board.  In connection with that role, he served as the Board Solicitor during evidentiary hearings, issues findings of fact and conclusions of law and advisory opinions for nearly twenty (20) years.  In 2014 and 2015, Mr. Smith served as a part-time Solicitor for Montgomery County assisting the Office of the Controller.  In addition, he has served as special counsel to the Lower Salford Township Authority.  In connection with Short-term Rental matters, Mr. Smith routinely litigates against local municipalities.

Active in the Montgomery Bar Association since 1998, Mr. Smith served as the Association’s President in 2017, and Co-Chair of the Association’s Autonomous Judiciary Committee since 2019.  Mr. Smith has been a member of the Pennsylvania Bar Association’s House of Delegates since 2004.  In 2023 the Disciplinary Board of the Pennsylvania Supreme Court appointed Mr. Smith as a Hearing Committee Member and renewed that appointment in 2026.  Beginning 2025, the Montgomery County Court of Common Pleas appointed Mr. Smith to serve as a Civil Discovery Hearing Officer.
