An attorney with 24 years experience, Mark F. Walmer limits his practice on criminal defense. A 1980 graduate of Pennsylvania State University and a 1987 graduate of Franklin Pierce Law Center, Mark has a B.A in philosophy and a Doctor of Law degree.

Before opening his own firm, prior to joining Timoney Knox, he worked as a prosecutor for the Lancaster County District Attorneys office as well as an assistant public defender for Lancaster County Public Defender's office 1988 - 1991.

He is a member of the Lancaster Bar Association, American Bar Association, National Association of Criminal Defense Lawyers and the Pennsylvania Association of Defense Lawyers.

Additionally, he has been a frequent guest speaker at local high schools since 1995 on the topic of "Top Ten Juvenile Crimes and How to Avoid Them," and "Mandatory Sentences You Should Know About."

Representative matters handled by Mr. Walmer would include the following:

  • In 2009, Mark obtained an acquittal for a client charged with Murder in a fiercely contested case where the victim had died of multiple stab wounds. Mark successfully argued that the forensic evidence actually supported his theory of self defense. The client was pronounced "Not Guilty" and released from the Courtroom to rejoin his family.
  • In 2009, a client was charged with a felony Possession With the Intent to Deliver cocaine and was facing a five year prison sentence. After a jury trial, the client was acquitted when Mark proved that his client was not aware that there were two ounces of cocaine at his house.
  • In 2011, a client was charged with DUI for a checkpoint stop that had happened three years earlier. While the Commonwealth tried to prove that a bench warrant issued in 2008 and the client was avoiding the charges, Mark argued that the police were not diligent in attempting find the client and the charges should be dismissed. The Judge agreed and dismissed all charges.
  • Since 1997, Mark has obtained hundreds of expungements for his clients helping them to clear their criminal histories of charges ranging from DUI and Possession of Marijuana to summary offenses. Other felonies and misdemeanors that did not result in a conviction have also bee expunged.
  • Since 2007, Mark has filed dozens of Applications with the Governor's Board of Pardons seeking to have misdemeanor and felony convictions pardoned, or forgiven, by the Governor so they could be removed from the client's criminal history.
    In 2007, Mark filed an application for a Governor's Pardon on behalf of a college student who had a retail theft conviction preventing her completion of her teaching requirements. Mark went to Harrisburg with his client for the presentation, obtained the Pardon and cleared her record.
  • In 2007, a client was acquitted of Rape at a jury trial where Mark successfully demonstrated to the jury the inconsistencies in the victim's versions of events that raised a reasonable doubt as to her credibility.
  • In 2010, a client was charged with multiple felonies for falsifying documents and embezzling hundreds of thousands of dollars from a local bank. While the guidelines called for a sentence of jail, Mark stood with the bank's attorney and argued the facts of the case and the importance of restitution would make house arrest with work release an appropriate sentence. The Judge agreed.
  • In 2003, a client was charged with Murder which would require life in prison. After a jury trial, the client was convicted of Manslaughter - a reckless or negligent killing, not a deliberate killing, and was sentenced to 8 years in the state prison system.

Born and raised in Lancaster County, Mr. Walmer understands and appreciates the culture and the diversity of the county.

Outside of the courtroom, Mark coaches a girl's soccer team, plays the guitar and enjoys golfing and spending time with his wife and three children.
