Kevin Schmidt is the lead lawyer in the Firm's Subrogation Department, concentrating a high percentage of his work in the field of property subrogation recovery.  He has extensive experience handling commercial and residential property losses from early intervention through litigation and trial.  He has handled matters involving construction defects, industrial and consumer product failures, structural failures, utility failures, vehicle fires, explosions, fire spread, and water damage. 

He is an active member of the National Association of Subrogation Professionals (.html) and has been named a Pennsylvania Super Lawyers' Rising Star in 2010 and again in 2011.

Kevin also handles and litigates personal injury matters. In addition to his litigation practice, Kevin acts as counsel for numerous businesses and corporations.  

Representative cases handled by Mr. Schmidt would include the following:

  • Over the last ten years has handled hundreds of property subrogation matters ranging from small to large for many prominent carriers with high percentage, value-added results.
  • Recently obtained large six figure arbitration award against product manufacturer for significant water loss in residential property.
  • After multiple lawsuits filed against large product manufacturer for specific defect, persuaded manufacturer to enter into Universal Claim Handling Settlement Agreement with client that resolved over seventy (70) additional claims pre-suit.
  • Recently settled a complex product liability matter in litigation where product manufacturer defendant asserted "unintended user defense" against client's insured, who was an innocent bystander damaged by the malfunctioning product. The defense alleged the client's insured was not a "consumer" as defined by the Restatement (Second) of Torts because they did not purchase the product and therefore had no standing to bring its subrogated Strict Product Liability claim. Focused advocacy of clients rights through legal research and writing resulted in the dismissal of defendant's motion to exclude the strict liability claim, ultimately leading to resolution of the case before significant legal costs were incurred by client.
  • Lead investigation and evidence retention for prominent carrier on seven figure national restaurant chain kitchen fire involving commercial fire suppression system.
  • Recently resolved complex water loss matter involving multiple contractors through aggressive negotiations and case presentation/preparation. The matter was resolved pre-suit within five months of receiving file from client.
  • Recently obtained substantial settlement in large apartment complex fire in mediation between multiple parties.

Prior to joining the firm, Kevin was an associate with White and Williams, LLP in Philadelphia.  At White and Williams, he was in the subrogation/property department, practicing exclusively in the field of insurance subrogation throughout a 21 state territory under the subrogation/property department program.   

Kevin obtained his undergraduate degree from Gettysburg College, where he was captain of the varsity football team.  Kevin earned his law degree from Widener University School of Law.  During law school, he was an Assistant Clerk for the Honorable James J. Fitzgerald III of the Philadelphia County Court of Common Pleas.  Following law school, he served as a law clerk to the Honorable William R. Carpenter of the Montgomery County Court of Common Pleas.  Kevin is admitted to practice in Pennsylvania and New Jersey.

Kevin is also active in the community.  He is an assistant football coach at his alma mater, LaSalle College High School, and is an Executive Board Member of the Philadelphia Stewards Alliance, the mission of which is to promote and bring resources to the four special needs/special education schools operated by the Archdiocese of Philadelphia.
